Terms of Service

01Acceptance of Terms
By accessing or using the Forevue platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are accepting these Terms on behalf of a law enforcement agency, government entity, or other organization, you represent that you have the authority to bind that entity. If you do not agree to these Terms, you may not use the Service.
02Description of Service
Forevue provides an Intelligence Layer for law enforcement Pre-Offer Screen workflows. The Service includes applicant questionnaire delivery, administrative reporting, and agency dashboard access. Forevue is a screening intelligence tool and does not make hiring decisions. All employment decisions remain the sole responsibility of the subscribing agency.
03Authorized Use
The Service is intended exclusively for use by authorized law enforcement agencies, government entities, and their designated personnel for pre-offer employment screening purposes. You agree to use the Service only in compliance with applicable federal, state, and local laws, including but not limited to the Fair Credit Reporting Act (FCRA), Equal Employment Opportunity (EEO) regulations, and the Americans with Disabilities Act (ADA). You shall not use the Service for any purpose other than pre-offer behavioral screening of law enforcement applicants.
04Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify Forevue immediately of any unauthorized use of your account. Forevue implements role-based access control and audit logging, but cannot be held liable for unauthorized access resulting from compromised credentials that were not promptly reported.
05Data Ownership & Licensing
Applicant data submitted through the Service remains the property of the subscribing agency. Forevue is granted a limited license to process this data solely to provide reporting through the Intelligence Layer. Forevue retains ownership of its software, documentation, and analytical methods. Agencies may not reverse-engineer, decompile, or attempt to extract Forevue's protected implementation details.
06Service Availability
Forevue targets 99.9% platform uptime. Scheduled maintenance windows will be communicated at least 48 hours in advance. Forevue is not liable for service interruptions caused by third-party infrastructure providers, force majeure events, or circumstances beyond our reasonable control.
07Limitation of Liability
Forevue provides the Intelligence Layer as an analytical tool. Reports are not clinical diagnoses, legal opinions, or employment recommendations. Forevue shall not be liable for hiring decisions made by agencies based on platform-generated reports. In no event shall Forevue's total liability exceed the fees paid by the agency in the twelve months preceding the claim.
08Indemnification
You agree to indemnify and hold Forevue harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your agency's employment decisions. Forevue agrees to indemnify agencies against claims arising from Forevue's negligent handling of applicant data or material breach of its security obligations.
09Termination
Either party may terminate the Service agreement with 30 days written notice. Upon termination, Forevue will provide a 30-day data export window, after which all agency and applicant data will be permanently purged in accordance with our Data Retention Policy. Termination does not relieve either party of obligations incurred prior to termination.
10Governing Law
These Terms are governed by the laws of the State of Texas without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in Austin, Texas, unless the agency is a government entity that cannot consent to arbitration, in which case disputes shall be resolved in the federal or state courts of Travis County, Texas.
