Sole Source Justification Template

Structured sole source support language agencies can adapt for local procurement review, including implementation posture and acquisition framing.

This template provides customizable sole source justification language for agencies procuring Forevue's pre-offer behavioral screening platform. Agencies should review the language with their procurement officer and legal counsel before submission. All bracketed fields require agency-specific information.

Usage Note

This template is provided for agency convenience only. Forevue does not provide legal advice. Agencies should verify compliance with their jurisdiction's procurement regulations before submission.

Section 1: Sole Source Justification Statement

TO: [Procurement Authority / City Manager / Board of Supervisors]

FROM: [Department Head / Chief of Police / Hiring Authority]

SUBJECT: Sole Source Justification, Pre-Offer Behavioral Screening Platform

DATE: [Date]

This memorandum provides justification for the sole source procurement of a pre-offer behavioral screening platform from Forevue Insights, LLC, at an annual subscription cost of $4,900 for the [Standard / Professional] tier.

1.1 Requirement

[Agency Name] requires a structured, pre-offer behavioral screening instrument that collects biographical and behavioral history data from peace officer applicants, produces a risk-prioritized investigative brief for trained background investigators, and operates within the pre-conditional-offer legal boundary established by the Americans with Disabilities Act and California Code of Regulations Title 11, Section 1953(d).

1.2 Proprietary Technology Test

The following characteristics of the Forevue platform distinguish it from general-purpose survey, assessment, or background investigation software:

  • Structured pre-offer screening workflow derived from publicly available California POST research and related selection standards.
  • Pre-offer/post-offer regulatory boundary enforcement ensuring no data collection occurs outside the lawful pre-conditional-offer scope.
  • Structured output formatted as an investigative brief for human review by trained background investigators, not a suitability determination or diagnostic report.
  • Applicant-facing questionnaire interface compliant with ADA accessibility standards and designed for applicant clarity.

1.3 Market Analysis

A reasonable survey of available commercial products in the law enforcement screening market confirms that no alternative product provides the combination of: (a) pre-offer permissible data collection, (b) research-aligned structured review, (c) investigator-formatted output, and (d) ADA-compliant applicant interface at a comparable price point.

Existing alternatives fall into one of the following categories, none of which satisfy the stated requirement:

  • Post-offer psychological evaluation tools (e.g., MMPI-2-RF administration platforms): restricted to post-conditional-offer stage; cannot be used pre-offer.
  • General-purpose applicant tracking systems: do not include Forevue's structured pre-offer review workflow or investigator-formatted screening output.
  • Background investigation management software: manages the investigation workflow but does not perform pre-offer behavioral data collection or risk prioritization.

1.4 Cost Justification

The annual subscription cost of $4,900 ([Standard tier: up to 140 applicants] / [Professional tier: up to 300 applicants]) represents a per-applicant cost of approximately $35 to $16, depending on tier and volume. Documented training costs for a single officer range from $100,000 to $240,000 (Force Science Institute, 2022; National Police Foundation via FPPTA, 2024). Preventing even one high-risk applicant from advancing through the full training pipeline produces an immediate return exceeding 20:1 on the annual platform investment.

1.5 Micro-Purchase Threshold Alternative

If applicable under the procuring jurisdiction's regulations, the $4,900 annual subscription falls below the federal micro-purchase threshold of $10,000 (FAR 2.101) and may fall below applicable state or municipal simplified acquisition thresholds, potentially allowing procurement without formal competitive bidding requirements.
