ADA Framework

The ADA prohibits medical examinations and disability-related inquiries before a conditional offer of employment. The EEOC defines a "medical examination" as a procedure or test that seeks information about an individual's physical or mental impairments or health.

Instruments that collect biographical and behavioral history data, without being designed to detect or diagnose mental health conditions, are not medical examinations under the ADA. This distinction is the legal basis for pre-offer biographical screening.

California CCR 1953(d)

For California agencies, CCR Title 11, Section 1953(d) defines the pre-offer/post-offer boundary for peace officer background investigation data collection. The regulation specifies that biographical history, personal statements, employment verification, character references, education verification, and financial history fall within the pre-offer permissible scope.

IACP Professional Standards

The IACP Preemployment Psychological Evaluation Guidelines (2014, updated 2020) establish nationally applicable standards:

  • Guideline 3.4: Psychologists should obtain and analyze non-medical information at the pre-offer stage whenever possible.
  • Guideline 3.5: Normal-range personality traits may be assessed pre-offer, provided the assessment is not designed to detect disabilities and does not require a health care professional to administer.

OPM Biodata Classification

The U.S. Office of Personnel Management classifies biographical data (biodata) instruments as a valid assessment category for personnel selection. OPM guidance notes that targeted biodata instruments predict counterproductive behaviors including criminal misconduct, substance abuse, employment misconduct, and fraud.

  • Instrument is not designed to detect or diagnose mental health conditions or disabilities.
  • Instrument does not require administration by a licensed health care professional.
  • Data collected falls within biographical and behavioral domains permissible at the pre-offer stage.
